I used an agent to find a contractor.
The contractor completed breached our writen contract. The contractor agreed to complete 6 items. Two of them, he made a "stab at".
Four of them, he didnt even try.
The agreement was made in August of 2012. The entire work was supposed to be completed by November of 2012. He is in breach.
However, it is the "agent" who got a chunk of the large fee that I paid $3,500. The agent is the party which kind of had the deep pockets. I want a legal analysis of the agents contract (and the providers contract) but i want a short memo describing the legal theory of holding the agent liable for breach of contract (under California law).
