I need some legal consultation regarding an eviction that is in process.
The tenants moved in mid February in my two bedroom condo in San Marcos, California. A lease had been signed February 8, 2014 with an agreement to pay $1195 a month with $1195 deposit. Additionally, there are clauses in the lease that the tenant would be responsible for any legal fees resulting in a dispute. Regrettably, the check written for the deposit could not be deposited since it was more of a gesture to hold the property.
So far, they have paid for the first half of the February for $640, and paid $280 for their first payment for March. That said, they still owe $1195 for the security deposit, $56 for the SDG&E Bill, and $915 for the March rent, and $150 for late fees.
I had served them a Pay Rent or Quit Notice on March 5, 2014. I am in the process of filing an unlawful detainer. I need assistance in determining that I am filing this correctly.
