Large International Food market Company & My company entered into a $1,050,000. three month Building and store renovation contract. All the docs, the plans ,specs and the contract were developed AIA by their local NYC Architect + contract manager. This contract and all docs,were Signed and initialed by myself and the supermarket companys traveling Director of Engineering. As directed, I then duplicate copies then FEDEX sent; to the company's corporate office along with the first payment application request. This contract, had a critical 3 month turn around schedule we were to do the renovation in 3 phases, timing also hinging on customer's decision making, providing certain equipment, coordinating owner outside side subcontractors( IT and Phone).etc. All Insurance certificates I acquired and submitted to get the Building permits which I posted on the front store window. I gave Con Ed notifications in writing, I engaged, all my subs and awarded their contracts,( Electrician, Plumber, Demo contractor, Sprinkler engineer, HVAC contractor and sprinkler. Mill work shop, Carpenters, and Masons & Painters . Most factors, Emailed backup, and trail, also Architect verification. We are were all set to go and make this project happen on the date specified. On the week scheduled to start No money ever came, two weeks go by, the Director told us there was a delay, bosses decided not to start because of the Holiday coming up we should wait. As the holiday passed , we called as to when to start, He said lets meet at the architect's' office in NYC to form a new ;plan to restart, we did . Plan was set for January begining10th--or 20th depending on final drawings and engineering. Time passes no money , no start. I begin to complain, no good answers, delayed because of some corporate excuses. Director kept in touch asked us to do some small other maintenance jobs,. which we did , then started asking for estimates on many things for 5 other stores in region, lots of footwork and time spent for these prices + estimates, we were given some work but mostly just bids, nothing substantial. I kept pursuing our signed contract and when the store would be ready to go---always a delay for one reason or another we were patient. One Year passes,,, they sent a CAREFULLY written email asking me to cancel their contract !! (because the original contract and designs are now changing), I never replied I think we are screwed. this was Fall of 2011, today on BIDCLERK I just witnessed a notice to BID for this same store renovations contract to general public! No deference being given to me and my SIGNED CONTRACT, the Value of it, or otherwise. We now know they are not broke and have simply ignored us . By our calculations we would have worked, our subs would not be mad at us, and ,we would have profited 33% any Ideas? I think AIA " Termination for convienice " will stick! I want a good NY lawyer! I am in Westchester CT.
