We are looking for a review for Canada of the existing legislation (federal and provincial) and related policies and guidelines for the handling of medical records, in particular their conversion, sharing, archiving and disposal. From a number of perspectives:
1) Precedent Summary - Background: cases have been tried regarding the handling of medical records (especially electronic). We'd like a summary of those cases. Imagine preparing for a case where a patient was suing on the grounds of improper medical record handling / disposal, what foundation references would you want to review to create an opinion paper or litigation plan in preparation (from the perspective of the plaintiff (patient) and the doctor (defendant). Deliverable: A list (name, date, jurisdiction, and summary) of cases regarding medical record handling - especially those that reference these lesser known handling requirements, and those that involve archiving and destruction.
2) Role of Copyright - Background...
