This plaintiffs case involves FLSA, alter ego, and breach of contract. Our counter claim involves breach of contract, business tort, and fiduciary duty.
Our situation is best described as having to defend a frivolous lawsuit with a strong counter suit. We are represented by a sole practitioner, who normally fulfills all our small business needs, but has limited resources to handle litigation. Our attorney has placed most of the discovery tasks upon us, which we simply do not have the time to complete. We completed all answers to interrogatories and request for documents, with little involvement from our attorney. Our attorney has taken many "short cuts" like cutting and pasting the Plaintiff's interrogatories and request for documents; making only slight changes such as find and replace names, then sending back as our discovery requests.
