Hi, I have a team that is looking to make a effervescent tablet (ex. alka-seltzer, AirBourne, etc.) that is flavored, vitamin enhanced, and targeted at the spirits market.
First question, is it possible to get a patent on our formula, even though it resembles other effervescent tablets formulas?
Second, I see this company ( [obscured] /products/endurolytes-fizz.elf.html) has a patent pending on there formula (or the Wheat Germ Oil, I can't tell), if that is the case, can we just switch to use a different oil and get a patent on our unique blend?
What would the process, cost associated with applying for a patent be?
