We are launching a new product and we have a name and corresponding domain name in mind. Before we purchase the domain name, I would like to learn a bit more about the situation with regard to trademark/use of the name.
1) I see that there are some very similar names/trademarks in use. However, they are used in different industries and in different ways/locations. How does this effect our ability to use and protect the mark/name for ourselves?
2) The name is not that unusual and we'd like to have a clear idea of what we can do to protect our right to use it. What other considerations exist? What is the best way to move forward?
We are looking for an attorney/legal adviser who can provide us with some very clear and actionable advice regarding the viability of the proposed name/domain so that we can move forward with it or find a new name accordingly.
