I am seeking an attorney to discuss the rights of freelancers. Specifically, if a person has been employed full time at a large company for three years, receives a W2, has own desk and computer, and must abide by rules of employees (such as filling out employee time sheets, putting in for time off) but without receiving any benefits (such as paid vacation, health insurance, sick days). I need to know if there are any laws that protect freelancers. Is there any way to make them hire you? Could it be retroactive? Only allowing 30 mins for lunch (even though the work days are typically 8+ hours? etc. The person does not have a contract and was not hired through an employment agency. The person was hired on the recommendation of a friend at the company. The company is a well known advertising agency in New York City and is a subsidiary of a very large corporation.
