Our company, founded in 2010 and located in Europe, filed for a international trademark on our business name, based on our national Austrian trademark registered in 2011. We received a Certificate of Registration from WIPO in April 2012.
One month later however, the WIPO notified us of the US patent office's provisional rejection of our registration on the grounds of "Likelihood of Confusion" with two existing marks (one pending) and some required additional information.
These existing marks share in part one similar stem word of our "portmanteau" type mark but:
1. Our mark does not use the full stem of the word
2. The word in question is the name of the service concerned and thus should not be blocked.
3. The identity of the FULL stem with the two existing marks (one pending).
