Word Limit: 1,500 Question "In my view the Court's reasoning - although not the result - in Keck is unsatisfactory for two reasons. First, it is inappropriate to make rigid distinctions between different categories of rules, and to apply different tests depending on the category to which particular rules belong... Secondly, the exclusion from the scope of Article [34 TFEU] of measures which "affect in the same manner, in law and in fact, the marketing of domestic products and those from other Member States" amounts to introducing, in relation to restrictions on selling arrangements, a test of discrimination. That test, however, seems inappropriate." Case C-412/93, Societe d'Importation Edouard Leclerc-Siplec v TF1 Publicite SA and M6 Publicite SA [1995] ECR I-179 at paras. 38-39 per Advocate General Jacobs. Critically discuss with reference to relevant treaty articles, decided cases and academic opinion.

I will provide you with a spreadsheet containing 640 terms/phrases (all four words or less). A sample including the first 20 is attached. This job involves for 3 things: 1) Assemble a list of "primary" categories of law. I'm trying to keep the number of primary categories between 15-25, this is up for discussion but the point is to keep things simple. 2) Associate each term/phrase on the spreadsheet with a specific primary category. 3) Determine whether each term/phrase is "natural language", a "primary category", a "specialty", or an "issue" (attached sample has more details) The first project milestone would be the determination of the Primary categories, along with some notes describing your selection process and why you chose as you did. The second milestone would be to complete the spreadsheet by associating each term with one of your primary categories. I will need that data before I need the terms defined. I am looking f...

I am in need of a legal expert in contract law to help advise on how to handle a tricky situation that has arisen. In brief, a party has sent out substantial checks for an expected payment, but included with them an unexpected document stating that cashing the check implies acceptance of "transfer of your IP rights share" to a designated trust. I am trying to determine whether such a statement is in fact legally enforceable, and whether the party in question is allowed to extract these sorts of concessions in exchange for a payment which was expected. I may need to send a nasty letter, or perhaps go further. Expertise in California state law preferred, though not required. Looking forward to working with you.
