Fixed Price: Not Sure

We hired a contractor to make and install a metal railing for our backyard. We were under the impression that he was licensed, it turned out he was not. (There is no written contract, since he did complete the kitchen paint job we assumed that he was a trustworthy guy, our mistake). The railing job was suppose to be completed around Thanksgiving last year, and it is still not completed. He poured the concrete and put in wooden steps last November and that was the only and last work he did. We gave him two checks for a total of $1450, and his colleague $200. We've tried to call, email, text, twitter but communication was limited. On his last email and voice mail message he quit and said he would refund us the money in its entirety, and that the check was in the mail (which was emailed on March 3). There is no check, and I need a demand letter from a lawyer to get our money back.
