We are a staffing firm that operates in multiple states. We are looking for legal counsel to work on call for legal direction in multiple areas such as: co-employment risk mitigation, benefits (new ACA guidelines), contract review, general employment law. Our preference would be to have someone knowledge - but pleasant to work with... :-) Someone with knowledge of employment law in multiple states is helpful. Currently, we have employees working in AZ, CA, TX, Maryland. However, we are a registered corporation in additional states.

I performed work as a second tier sub-contractor for a federal DOD project. I thought my work was complete in June 2014 so I sent an invoice for my work. While I was waiting for payment in August I was asked to do a minor revision to my work. I was never paid, so I sent a claim letter in October to the bonding company of both the General Contractor and Sub-Contractor stating that I wanted to make a claim. They rejected my claim sighting the Miller act and that I needed to file a claim within 90 days of finishing work. I just realized that I technically did perform work within 90 days of filing that claim (because I performed a revision in August). So, in my non-legal mind, I did file the claim within 90 days of filing my claim and technically did comply with the Miller Act. If you think I have a descent shot, let me know and I'll have you prepare a letter.

We currently provide our staff Full reviews (job performance and salary increase) on yearly cycle. In addition to the yearly, we do another 6 month review just to give feedback on job performance. The reviews we conduct are just purely question and feedback related job performance. I feel our review doc is too simple and missing various questions that can assist in an employee termination. I am a real estate developer/and investor. I hire construction contractors of all types. With a current project I have a General Contractor and together we are hiring subcontractors. I need help determining when a contractor needs comp, how much, appropriate coverage and when they don't. I get a lot of contractors that claim they don't need it in certain circumstances. e. g. my business partner and I are equal partners and therefore we don't need comp.
