We have built a web based communications application in PHP and require a Privacy Policy to place on our website. The privacy policy is being requested by our API partners who provide us with services related to the messaging we send. Specifically with regards to the social messaging we are integrating with LinkedIn, Facebook, Twitter and we need a privacy policy that allows us to access these sites, read all incoming messages on behalf of the person and send outgoing message on behalf of the person. Specifically with regards to SMS messaging and Voice Broadcasts we are integrating with Twilio and we need a privacy policy that allows us to send SMS messages and Voice broadcasts to contacts that are added to our communication system by a user of our system. The privacy policy needs to govern use of our general website as well as use of our communications platform.

I need someone to help us understand the legal implications of our Terms and Conditions when customers register through Facebook on our website / mobile app. When people register with an email address they tick the "Accept T&C's" box, however with Facebook this is bypassed. We need to understand how to enforce acceptance of our terms - maybe they are accepted by default when registering with Facebook.

I am planning a small bookstore to host eBooks for authors. I'll be subject to DCMA takedowns for copyrighted material. I'm concerned about scammers trying to resell fake books. I'm also concerned about scammers taking down legit books. I'm also concerned about wasting alot of time with this. I would like to prevent fraudulent takedowns, while accepting good takedowns. I propose this: 1) Require email verification (Facebook doesn't do this?) 2) Require a ccard to verify a the filer's identity. (Authorize, but not charge) 3) Charge a $75 fee if the person filing does not file a lawsuit if the notice is disputed. How crazy is this? If these are bad ideas, what are ways to identify the person making the request? What should I do if I receive a DMCA request by email from someone who chooses not to go through the regular process? I'd love an hour or two of your time to work these issues out. Thanks! Mike

I wrote an e-book back in April of 2014. I poured hours and hours, weeks and weeks and months into it. I recently discovered, after many of my readers pointed out to me, a website (that looks almost exactly like mine and even copied my sales copy) that is selling my e-book on their website as their own e-book, just with a different name and e-book cover. I tried reaching out to this person on Facebook, asking them to stop, but they essentially said to me "no" and "sue me". I'm paraphrasing, but that's essentially what they said to me. I sent a DMCA claim to his web host, who then took down his website. Unfortunately, this person actually stubborn enough to file a counter-DMCA claim in which, from what the web host tells me, obligates them to put his website back up. He basically lied, perjury, and I have a signed document from him that he sent to the web host, who forwarded it to me, saying he didn't copy my e-book or website. Here's a blog post I wrote recently...

I have a acquaintance that sub-leased a apartment that I was renting from October 2011-January 2012. During that time frame, rent was $425 a month with $50 in utilities. I was paying the rent and had a sublease agreement with my landlord. The reason that I was subleasing is that I was a part of the US Marine Corps Reserve and was activated for a deployment in Afghanistan from October 2011-November 2012. In January of 2012, my landlord had to kick the gentleman subleasing out due to complaints and violation of the lease agreement. In addition, I had a bed, couch, and two end tables that were destroyed by this gentleman. Over the last two and a half years (included limited email and skype connection in Afghanistan) I have tried to recoup the financial cost of these items. I have conversations via text and Facebook messaging where this gentleman admits to owning me the money and arranges times to meet up and repay me but he consistently never showed up. I value the rent at $1900 and pro...
