I'm a realtor, and I have a closing tomorrow morning at 9am. My client has gotten a power of attorney letter so that his brother can sign the documents on his behalf. The letter was done in New York, and Florida has different requirements. I just need an opinion letter from a licensed New York attorney that the POA was done correctly. This is the issue per the Title company: Florida Power of Attorney require 2 witnesses and a notary. The notary should reflect proper , i.e. sworn to, subscribed and acknowledged by . . . In lieu of the 2 witnesses, since this is for the purchase of real property, POA executed in NY, we may accept a written opinion letter of a NY licensed attorney, in good standing, advising that the POA is properly executed in accordance with the laws of New York, for purposes of purchasing, mortgage and encumbering real property. The original POA will need to be recorded, with the opinion of NY Counsel attached and a POA Affidavit.
