I represent a company which is looking into the possibility of establishing either: (i) a joint venture (JV) in India; or (ii) a quasi-employment arrangement, where a US company directly hires individuals working in India from the United States, but the individuals work in the offices of existing Indian companies and the US company pays the Indian company an on-going referral fee. The work involves outsourcing transcription services from a state-level agency in the United States. Seeking assistance with determining the prejudicial error and judicial misconduct in sentencing in a California three strikes law case. The defendant was charged with two separate crimes and prior to sentencing he had two strikes from one previous incident. Prior to the jury returning with the verdict the trial judge stated that he would remove one of the previous strikes because it was an error made by a previous judge. When the jury returned with a non-guilty verdict on one of the charges, resulting in only one additional strike and not two, which would have substantiated a sentencing under the three strikes law, the judge decided not to remove one of the previous strikes that he stated that he was going to remove. This resulted in the defendant being sentenced under the 3 strikes law when he only had two strikes based on the judges removal of one of the previous strikes.
