“As per contract we were suppose to work Milestones wise. We completed MS1, MS2 and MS3 milestones successfully with all the agreed functionality and QA. Client was satisfied with our work, execution, working style and Mtoag development team. But suddenly at the end of MS3, he came up some of personal reasons and asked us to hold project for some time. As a professional company we just requested for the MS3 payment and were certainly ready to hold the project till he want.
We worked as per client instructions. Before every step we took approval from the client. He agreed to starting milestone, approved milestone plan, reviewed milestones and moved on to next milestones. All of sudden he wanted us to stop project, and it was not a gentleman''s move at all. Even after all those things, we are ready to cooperate and just requested for the amount of the work done. The main issue was, our denial transferring code without payment. Because of these things he started to send us lots of issues like Code quality issues with a external company, demo server issue, bug tracker issues, delay issues, documentation issues and threatening issue. He did not even had a single solid reason to cancel a project when substantial work had already been completed.
The case was further submitted to Elance for dispute resolution. Eleance/netArb appointed a impartial arbitrator, who initiated proceedings for dispute resolution. After listening both the parties and taking all the material on record into consideration, the Arbitrator "rules out all the allegation by the client and declared position of Mtoag Technologies fully correct. And ordered to release entire MS3 payment to Mtoag Technologies. The decision of arbitrator itself shows that we were not wrong and client was at fault.
